SPECIAL ADMISSION OF ATTORNEYS
The Court of BiH may, exceptionally and in accordance with
Article 6, paragraph 2 of the Law on the Court of BiH
and
Article 52 of the Rules of Procedure of the Court of BiH,
issue authorization for
a legal representative who is not on the OKO list of authorized defence attorneys
to act in proceedings.
This rule provides flexibility in court proceedings when circumstances require it.
Special admission of attorneys is
an exception, not the rule.
It is granted only when there are
objective and specific reasons
showing that such admission is in the interest of justice and consistent with the
right of the accused to a fair trial.
Who may be specially admitted?
A legal representative (attorney) who:
• is not on the attorney list maintained by OKO;
• holds a valid attorney licence from BiH or abroad;
• meets other criteria the Court deems relevant.
Criteria the Court may take into account
A judge or panel may consider:
• specialized knowledge of domestic or international criminal law, international humanitarian law, or human rights law;
• familiarity with the factual context of the geographical area and relevant cases;
• prior representation of the same defendant before domestic or foreign courts;
• previous representation before the Court of BiH in other cases;
• qualitative justification and fairness of the attorney’s request;
• the wishes and reasons of the suspect or accused;
• other facts relevant to the rights of the suspect or accused.
