Education on the topic “Principle of Opportunity” – February 23, 2026, Bijeljina

The Ministry of Justice of Bosnia and Herzegovina, Sector for Criminal Assistance and Education in Criminal Matters before the Court of BiH, in cooperation with the Bar Association of Republika Srpska, on February 23, 2026, in Bijeljina, at the premises of the Bar Association of Republika Srpska, held an educational session as part of the continuous professional training of attorneys titled “Principle of Opportunity”.

Chief District Public Prosecutor of the District Public Prosecutor’s Office Banja Luka, Mladen Mitrović, and attorney at the Bar Association of Republika Srpska, Saša Labotić, were the lecturers who delivered the training in accordance with the agreed agenda.

In addition to introducing participants to the source and application of the principle, emphasis was placed on the issue of the lack of precisely defined provisions governing this principle and the conditions for its application within the Criminal Procedure Code, as well as the fact that the application of this principle would significantly reduce the number of unresolved cases, i.e., enable faster case processing by judicial authorities.

Regarding plea agreements and plea negotiations, it was stated that these processes are subject to the rules of “initiative–negotiation–agreement”, with the obligation to respect formal requirements and the role of the court.

The lecturers emphasized that the principle of opportunity achieves its best effect through the prosecutor’s right to discontinue criminal prosecution / withdraw the indictment.

During the training, the issues related to the principle of opportunity in Bosnia and Herzegovina were realistically presented from a normative perspective, highlighting that the application of this principle, which is well regulated in neighboring countries, has a greater impact than the punishment itself.

In support of the above, the lecturers presented the structure of imposed sanctions.

Through their thorough presentation of the topic and interaction with participants, the lecturers contributed to a highly valuable and high-quality educational session.
